b) Filing Particulars Compilation

b) Review and Report with a trademark application number assigned by the designated intellectual property office (IPO) in respective country

3. Examination Stage (subject to variation according to specific country)
a) Review and Report office action, if any, from designated intellectual property office (IPO) in respective country;

b) Review, Submit and report response to office action, if any, issued by designated intellectual property office (IPO) in respective country;

Reporting format: doc or pfd format
Report Delivery: email, fax, post.

4. Registration Stage (subject to variation according to specific country)
a) Acceptance
  • Review and report of the issuance of Notice of Acceptance from designated intellectual property office (IPO) in respective country;
  • Review, prepare publication materials (artworks) and Submit to designated intellectual property office (IPO) in respective country;
  • Review and Report publication by forwarding copy of publication from designated intellectual property office (IPO) in respective country;

b) Opposition
  • Review and report of 3rd party opposition, if any.
  • Review, Submit and report response to 3rd party opposition

Trademark in Malaysia - FAQ
  • How long does registration processs take?
    It is estimated to take about 2-3 years for the Certificate of Registration to be granted. The time frame depends if there are any oppositions and the complexcity.

  • How long is the registration valid for?
    Trade marks registration is valid for 10 years upon granted. It may be renewed every ten years for subsequent periods of 10 years.

  • Does Malaysia accept priority applications?
    Priority applications are accepted as long as they are filed within 6 months from the date of the priority application.

  • Does Malaysian Registration provide International Protection?
    Seperate registration is required for each country where the right is to be protected. For countries which are party to the Paris Convention and WHO, a Malaysian application can be used as a basis for claiming priority.

  • What is the Malaysia Trademark Registration Process?

  • It's advisable to conduct a comprehensive search on the trademark to be registered prior to the registration process. Each application will be reviewed for its registrability. Accepted trademark is required to advertise in Government Gazette to allow any party to forward their opposition on the registration of the trade mark. A Registration Certificate will be issued, if there is no opposition.
